WHO WE ARE

Beauchamps comprises Beauchamps LLP, a limited liability partnership regulated by the Legal Services Regulatory Authority, and any entities owned or controlled by it including HBK Secretarial Services Ltd and Beauchamps Services ULC.  References in this statement to Beauchamps, "we", "us" or "our" includes each of these entities.

WHEN DO WE PROCESS YOUR PERSONAL DATA?

We may process your personal data:

  • When you, or an organisation with which you are connected, are our client (see Client Privacy Statement)
  • When you access our website (including B-Connect) (see below) or
  • For marketing and business relationship management purposes (see below).

WEBSITE AND B-CONNECT

Collection of personal data when you visit our website (including B-Connect)

We collect personal data about you which you volunteer when you use our website or when you contact us through our website.  For more information about how we collect your personal data, please refer to our cookies policy.  

What personal data we collect you visit our website (including B-Connect)

The personal data which we collect and process about you may include:

  • your name
  • your email address
  • your employer and your job title
  • your home and business address, telephone number and mobile number
  • your IP address, the browser software and operating system that you use and the URL linking you to our website
  • the date and time you access our website
  • the content you access
  • Any information you chose to include in your profile when you register to use B-Connect, including your photograph
  • in respect of B-Share, details relating to your, or your organisation's matters, enquiries and other dealings with us, the content you access, communications you post and documents you upload
  • in respect of B-Learn, the length of time you spend and your CPD hours gained from accessing content 
  • the areas of law in which you have expressed an interest and
  • any other personal date which you provide to us directly.

We also collect personal data automatically when you visit the website, as explained in our cookie policy.  The provision of this information to us is not a statutory or contractual requirement and you may refuse to provide this.  However, we may not be able to provide the B-Connect services to you if you do not allow us to collect this personal data.  In particular, if you refuse to allow us to collect data about what you watch on B-Learn and how much time you spend on B-Learn, we will not be able to certify your CPD.

The legal basis for processing your personal data 

We are required to have a legal basis to process your personal data.  We will only process your personal data where you have provided your consent and/or for the purpose of our legitimate interests.  

Consent.  When you register for any of our B-Connect services, you will be asked to consent to the processing of your personal data in accordance with this privacy statement.  

Legitimate interests.  We may obtain and process personal data where we have a legitimate business interest in doing so, including:

  • to provide you with access to our website and to B-Connect
  • to provide you with information, products and services which you have requested, or which you have consented to receive 
  • to improve, monitor and test the effectiveness of our website, the B-Connect platform and other products and services we offer
  • for statistical analysis on the use of our website and B-Connect

  • to comply with legal obligation

  • to keep a record of the CPD hours earned on B-Learn and to provide CPD certificates 

  • notify you about new content on B-Learn and B-Aware and/or changes to our service
  • to protect the security and integrity of our website, B-Connect, IT systems and other systems

When we process your personal data based on our legitimate interests, we balance any potential impact on you and your data protection rights. We will not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted by law).

Retention of your personal data 

When you access B-Learn, we will retain a record of your personal data including the content you have viewed and the CPD hours you have earned, and any CPD certificates issued to you, for a period of two years, so that we can assist you with complying with any CPD audit that may arise.  Otherwise, in connection with personal data we collect on our website and B-Connect, we will store your personal data only for as long as is necessary for the purposes outlined above and

  • to provide access to B-Connect and related services
  • to provide you with information, services and publications requested by you;
  • as required by law and 
  • to exercise or defend any legal claims.

Disclosure of your personal data 

We may disclose your personal data to other organisations in connection with the above purposes, including:

  • to third parties we engage to provide a service to us (eg our internet service provider, Moodle, the provider of the B-Learn platform technology and other third party service providers as data processors) and who are bound by confidentiality provisions or
  • if we are under a duty to disclose or share your personal data in order to comply with any legal obligation or
  • where necessary for our legitimate business interests to protect the rights, property, or safety of Beauchamps, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

In the event of an actual or threatened litigation as well as any investigation or audit by regulatory authorities or any other third party, destruction of any personal data may be suspended.  Routine destruction may also be suspended in the event of a merger of Beauchamps with another organisation or the replacement of Beauchamps’ IT systems.

MARKETING AND BUSINESS RELATIONSHIP MANAGEMENT 

Collection of personal data which we process for marketing and business relationship management 

We may collect your personal data for marketing and business relationship management purposes when you or your organisation:

  • subscribe to, or express interest in, any of our bulletins or ezines, or access to any of on-line platforms
  • attend, or express an interest in, any of our events or seminars
  • give us feedback
  • engage us, or enquire about engaging us, to provide legal services
  • communicate with any of our partners or staff
  • visit our office
  • work with us or supply us with services, or offer to and
  • when you supply your personal data to us via our website, by email, in person, by telephone, by social media or otherwise.

What personal data we process for marketing and business relationship management 

For marketing, business operation and relationship management purposes, we will collect and process personal data including:

  • your employer, your job title and/or position
  • your contact details, including your address, email address and phone number
  • CCTV footage, when you visit our office
  • Any information you chose to include in your profile when you register to use B-Connect, including your photograph

  • the areas of law in which you have expressed an interest and 

  • information relating to your subscription to, receipt of or interest in any of our mailing lists or newsletters, or registration to access B-Connect, or attendance at any of our events.

The legal basis for processing your personal data 

We are required to have a legal basis to process your personal data for marketing and business relationship management purposes.  We will only process your personal data where you have provided your consent and/or for the purpose of our legitimate interests.

Legitimate interests.  We may obtain and use personal data where we have a legitimate business interest in doing so, including:

  • promoting our firm
  • inviting you to events, seminars, webinars and meetings
  • developing and maintaining relationships with business contacts
  • conducting administrative and operational processes within our business
  • protecting the security and integrity of our premises, IT systems, online platforms and other systems
  • managing and administering our relationship with our business contacts and with our clients
  • sending you marketing material, bulletins, information about or services, legal updates and other information and
  • monitoring and analysing your receipt of, and interest in, material we send you.

When we process your personal data based on our legitimate interests, we balance any potential impact on you and your data protection rights. Disclosure of your personal data

We may disclose your personal data to third parties in accordance with contractual arrangements we have in place with these third parties, including:

  • suppliers and service providers to whom we outsource support services
  • IT service providers
  • third parties who assist us in marketing and promoting Beauchamps and
  • third parties involved in hosting or organising events or seminars.

When hosting or co-hosting events (such as client seminars or networking events) we may share the names and company names of attendees with our co-hosts and venues  Other than sharing the name, job title and company name of attendees at events, we will never share client or business contact personal data outside Beauchamps for marketing purposes without your express consent.

Data retention

If you are a client or business contact who has opted in to receive our marketing communications (such as our ezines and invitations to events), you will receive marketing communications from us for as long as you remain a client or business contact of Beauchamps and you have not availed of the option on every email to unsubscribe from receiving our marketing communications. You can, at any time, amend your preferences or unsubscribe by following the links within the footer of every email that we send or by contacting us at marketing@beauchamps.ie.  When we receive an “unsubscribe” request, we will remove your personal data from our marketing database. This will not affect general day-to-day business or client work which you may be involved in with us.

TRANSFERS OF PERSONAL DATA

Communication of information via the Internet and by email is not completely secure and involves the information passing through third parties.  In addition, communication of information via the Internet and by email may involve the transfer of personal data to third parties outside of the European Economic Area (EEA), including to a jurisdiction which is not recognised by the European Commission as having an equivalent level of protection for personal data as is provided for in the European Union. To the limited extent that it is necessary to transfer your personal data outside of the EEA, we will ensure appropriate measures are in place to comply with our obligations under applicable law governing such transfers. YOUR RIGHTS

You have the right to receive a copy of any of your personal data which we hold.  You may request that the information that we hold about you, if inaccurate, is rectified, or erased.  In addition, you have the right to object to the processing of your personal data as well as the right in certain circumstances to have your personal data transferred to another data controller.  Where processing of your personal data is based on your consent, you have the right to withdraw such consent.  We will respond to your request in writing as soon as possible and in any event within one month of receipt of your request.  We may request additional information from you to verify your identity and to enable us to respond to your request.  All requests should be sent by email to dataprivacy@beauchamps.ie or by post to Beauchamps LLP, Riverside Two, Sir John Rogerson’s Quay, Dublin 2, DO2 KV60, Ireland.

SECURITY

Beauchamps has implemented appropriate technical and organisational security measures to prevent unauthorised access to, or disclosure of, your personal data.  However, no data transmission over the internet (including by email) can be 100% secure, and so we cannot guarantee the security of any information transmitted to you or by you over the internet.  Any transmission of such information is at your own risk.

Our website (including B-Connect) may contain links to and from other websites.  Please note that we do not accept any responsibility or liability if you follow a link to any of those websites.  Please check the privacy policy of any such website before you submit any personal data.

AMENDMENTS TO THIS STATEMENT

We reserve the right to change this privacy statement at any time.  Any changes will be posted here and we will update the “Last Updated” date at the bottom of this statement. When you use our website after any such change, you will be deemed to have consented to the current version of the privacy statement and accordingly you should check the privacy statement from time to time.
